Terms of Service
These Terms are an agreement between you and Wimzi Games LLC ("Wimzi Games", "we", "us") for your use of our mobile games, including Wimzi Solitaire, and related services (the "Games"). By downloading or playing a Game you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Games.
1. Who can play
You must be at least 13 years old (or the minimum age in your country). If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
2. Your license
We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Games on devices you own or control, for your personal, non-commercial entertainment. The Games and all content in them are owned by Wimzi Games or our licensors. You may not copy, modify, reverse-engineer, resell or exploit the Games except as the law expressly allows.
3. Your account
An anonymous game account is created when you first play. You are responsible for activity on your account. Keep your player code private if you do not want others to identify you to support. If you delete the app without linking or recording your account, we may not be able to restore your progress.
4. Virtual items
The Games may include virtual coins, cosmetic items, power-ups, gifts and similar items ("Virtual Items"). Virtual Items:
- are licensed to you, not sold, and have no monetary value;
- cannot be exchanged for real money, goods or anything of value, and cannot be sold or transferred outside the Games;
- may be changed, rebalanced or removed by us, and may be lost if your account is closed or the Game is discontinued, without refund except where required by law.
If we offer purchases, they are processed by Apple or Google under their terms, are final, and are non-refundable except as required by law or the store's policy.
5. Rewards programs
If we offer a rewards or points program, separate program rules will apply and will be shown before you can redeem anything. Points have no cash value unless those rules say otherwise, and we may change or end a program as those rules allow. Our games do not offer real-money gambling.
6. Play fair
You agree not to: cheat, use bots, exploits or modified clients; interfere with the Games or our servers; harass other players; use offensive, misleading or infringing display names; impersonate anyone, including our staff; or break any law. We may remove content, reset progress, or suspend or close accounts that break these rules.
7. Ads and third-party services
The Games show ads and rely on third-party services (such as Apple, Google and Unity). We are not responsible for third-party content, products or services, and your use of them may be subject to their terms.
8. Changes and availability
We may update, change or stop any Game or feature at any time. We may update these Terms; if changes are significant we will let you know, and continuing to play after they take effect means you accept them.
9. Disclaimers
THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not promise that the Games will be uninterrupted or error-free, or that progress or Virtual Items will never be lost.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WIMZI GAMES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some places do not allow these limits, so they may not apply to you.
11. Governing law
These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Nevada, unless the law where you live gives you the right to bring claims in your local courts.
12. Apple App Store
If you downloaded a Game from the Apple App Store, these Terms are between you and Wimzi Games, not Apple. Apple has no obligation to provide support or maintenance for the Game, and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You also agree to Apple's standard Licensed Application End User License Agreement where it applies.
